§142. Agriculture and irrigation

(a) The Secretary shall in 1979, in 1983, and in every fifth year beginning after 1983, take a census of agriculture.

(b) In conjunction with the census to be taken under subsection (a) of this section in 1979, in 1988, and every tenth year beginning after 1988, the Secretary shall take a census of irrigation and.1

(c) The data collected in each of the censuses taken under this section shall relate to the year immediately preceding the year in which such census is taken.

References to the Secretary, meaning the Secretary of Commerce, were substituted for references to the Director of the Census, to conform with 1950 Reorganization Plan No. 5, §§1, 2, eff. May 24, 1950, 15 F.R. 3174, 64 Stat. 1263. See Revision Note to section 4 of this title.

Changes were made in phraseology.

Amendments

1986-Pub. L. 99–544 substituted "Agriculture and irrigation" for "Agriculture, irrigation, and drainage" in section catchline, and struck out "drainage" after "census of irrigation and" in subsec. (b).

1976-Subsec. (a). Pub. L. 94–229 substituted reference years of 1979 and 1983 for reference year 1959 and struck out discretionary power of Secretary to take agricultural census in conjunction with population, unemployment and housing census time frame contained in section 141 of this title.

Subsec. (b). Pub. L. 94–229 substituted reference years 1979 and 1988 for reference year 1959.

Census of Agriculture

Pub. L. 101–624, title XXIII, §2392, Nov. 28, 1990, 104 Stat. 4057 , provided that: "The Secretary of Commerce shall include questions relating to agricultural accidents and farm safety in thes [sic] 1992 Census of Agriculture."

Statistical Reports Issued On or Before June 30, 1976

Section 2 of Pub. L. 94–229 provided that the statistical classification of farms in effect on January 1, 1975, with respect to censuses taken under section 142 of title 13, was to be effective through June 30, 1976, and any such census was to reflect such classification, but could also include additional classifications as deemed appropriate by the Secretary.

1974 Agricultural Census; Submission to Congress Within 30 Days From August 10, 1973, of Estimate of Funds Needed for Census

Pub. L. 91–524, title VIII, §818, as added by Pub. L. 93–86, §1(27)(B), Aug. 10, 1973, 87 Stat. 241 , provided that notwithstanding any other provision of law, the Secretary of Commerce was to conduct a census of agriculture in 1974 as required by section 142 of title 13, and to submit to the Congress within thirty days after the date of enactment of the Agriculture and Consumer Protection Act of 1973 [Aug. 10, 1973], an estimate of the funds needed to conduct such census.
