§1438. Special low-income housing projects for elderly or disabled families; consultations; applicable design and equipment standards

The Secretary shall consult with the Secretary of Health and Human Services to insure that special projects for elderly or disabled families authorized pursuant to this chapter shall meet acceptable standards of design and shall provide quality services and management consistent with the needs of the occupants. Such projects shall be specifically designed and equipped with such "related facilities" (as defined in section 1701q(d)(8) of title 12) as may be necessary to accommodate the special environmental needs of the intended occupants and shall be in support of and supported by the applicable State plans for comprehensive services pursuant to section 6063 1 of this title or State and area plans pursuant to title III of the Older Americans Act of 1965 [42 U.S.C. 3021 et seq.].

Section 6063 of this title, referred to in text, which related to State plans for comprehensive services, was omitted in the general revision of chapter 75 (§6000 et seq.) of this title by Pub. L. 98–527, §2, Oct. 19, 1984, 98 Stat. 2662 , and a new section 6063 was enacted, setting forth administrative provisions for grants to university-affiliated facilities. Codification

Section was enacted as part of the Housing and Community Development Act of 1974, and not as part of the United States Housing Act of 1937 which comprises this chapter.

Amendments

1992-Pub. L. 102–550 substituted "elderly or disabled families" for "the elderly or the handicapped" in first sentence.

1984-Pub. L. 98–479 substituted "Health and Human Services" for "Health, Education, and Welfare".

Effective Date of 1992 Amendment

Amendment by subtitles B through F of title VI [§§621–685] of Pub. L. 102–550 applicable upon expiration of 6-month period beginning Oct. 28, 1992, except as otherwise provided, see section 13642 of this title.

Inapplicability of Certain 1992 Amendments to Indian Public Housing

Amendment by Pub. L. 102–550 not applicable with respect to lower income housing developed or operated pursuant to contract between Secretary of Housing and Urban Development and Indian housing authority, see section 626 of Pub. L. 102–550, set out as a note under section 1437a of this title.
