§7218. Sanctions

(a) Civil penalty

Any individual who violates section 7212 of this title shall be subject to a civil penalty, assessed by the Secretary in accordance with applicable law or by any district court of the United States, not to exceed $10,000 for each violation.

(b) Effect on operation of sections 207 and 208 of title 18

Nothing in this title shall be deemed to limit the operation of section 207 or section 208 of title 18. Nor shall any waiver issued pursuant to section 7212(c) of this title constitute a waiver of the requirements of such provision.

Prior Provisions

A prior section 603 of Pub. L. 95–91 was classified to section 7213 of this title prior to repeal by Pub. L. 103–160.

Amendments

1993-Subsec. (a). Pub. L. 103–160, §3161(c)(1)(E), redesignated subsec. (b) as (a), substituted "section 7212" for "section 7212, 7213, 7214, 7215, or 7216", and struck out former subsec. (a) which read as follows: "Any individual who is subject to, and knowingly violates, section 7213 of this title shall be fined not more than $2,500 or imprisoned not more than one year, or both."

Subsecs. (b) to (d). Pub. L. 103–160, §3161(c)(1)(E)(i), (ii), redesignated subsec. (d) as (b) and struck out subsec. (c) which read as follows: "Notwithstanding any penalty imposed under subsection (a) of this section, any violation of section 7215(a) of this title shall be taken into consideration in deciding the outcome of any Department proceeding in connection with which the prohibited appearance, attendance, communication, or submission was made." Former subsec. (b) redesignated (a).

Suspension of Effect of Subsections (a) and (c)

Pub. L. 101–510, div. A, title VIII, §815(a)(4), Nov. 5, 1990, 104 Stat. 1597 , and Pub. L. 101–194, title V, §507(4), Nov. 30, 1989, 103 Stat. 1760 , provided that former subsecs. (a) and (c) of this section had no force or effect during the period beginning on Dec. 1, 1989, and ending on May 31, 1991.
