§1460. Supplemental spouse coverage: reductions in retired pay

(1) That reductions in retired pay under this section are made in amounts sufficient to provide that the Supplemental Survivor Benefit Plan operates on an actuarially neutral basis.
(2) That such reductions are stated, with respect to the base amount (under the Survivor Benefit Plan) of any person, as a constant percentage of that base amount and, in the case of a person providing a supplemental spouse annuity computed under section 1457(b) of this title, a constant percentage of such person's base amount for each 5 percent increment specified in accordance with that section.
(3) That the amounts of such reductions in retired pay of persons participating in the Supplemental Survivor Benefit Plan (stated as a percentage of base amount)-
(A) are based on the age of the participant at the time participation in that Plan is first effective under this subchapter; and
(B) are not determined by any other demographic differentiation among participants in the Plan.
(4) That such reductions are otherwise determined in accordance with generally accepted actuarial principles and practices.

Termination of Retired Pay Reductions for Supplemental Survivor Annuities
"(1) Except as provided in paragraph (2), there shall be no reduction in retired pay under section 1460 of title 10, United States Code, for any month beginning after the date of the enactment of this Act [Oct. 28, 2004].
"(2) Reductions in retired pay under section 1460 of title 10, United States Code, shall be made for months after September 2005 in the case of coverage under subchapter III of chapter 73 of title 10, United States Code, that is provided (for new coverage or increased coverage) through an election under the open season provided by section 645 [set out as a note under section 1448 of this title]. The Secretary of Defense shall take such actions as are necessitated by the amendments made by subsection (b) [amending section 1457 of this title and repealing this subchapter] and the requirements of subsection (c)(1)(B) [set out in a note under section 1450 of this title] to ensure that reductions in retired pay under section 1460 of title 10, United States Code, pursuant to the preceding sentence are adjusted to achieve the objectives set forth in subsection (b) of that section."
